TERMS & CONDITIONS

All holidays featured on the blueskycycletours.com website are provided by Blue Sky Adventure Limited (Company registration number 08862541, registered address Wisteria Cottage, Sandecotes Road, Poole, Dorset BH14 8NT) and are sold subject to the following terms and conditions:

 

 

DEFINITIONS

 

“the company” means Blue Sky Adventure Limited.

 

“we” means Blue Sky Cycle Adventure Limited.

 

“us” means Blue Sky Cycle Adventure Limited.

 

“our” means Blue Sky Cycle Adventure Limited.

 

“you” means all persons named on the booking form.

 

“your” means all persons named on the booking form.

 

“finish” means the end of the cycle tour at the selected destination.

 

 

ITEMS INCLUDED

 

All details of what is included (and also what is not included) in your holiday are shown in the joining instructions that are issued upon booking confirmation and also on the website.

 

CONDITIONS PRECEDENT

 

It is your responsibility to ensure that you are sufficiently fit and healthy to complete your chosen tour and that your bike is fully roadworthy.

 

It is your responsibility to ensure that you arrive at the departure point in good time in accordance with the joining instructions.

 

INSURANCE

 

To take part in our holidays you must deliver to us proof that you have adequate insurance cover for baggage, equipment (to include bikes), medical expenses and cost of repatriation should you become too ill to continue your holiday.

 

PRICE

 

Prices quoted on the website or any of our literature are a guide only and may change at any time up to the point a contract is made between us.

 

After the contract is made we reserve the right to increase the price of the holiday in the event of circumstances beyond our control such as excessive rises in transport costs, exchange rate fluctuations or additional taxes. If we have to increase our prices you will be entitled to cancel your contract with us and receive a full refund.

 

LIMITATION OF LIABILITY

 

Road cycling is an inherently dangerous activity that can be exacerbated by adverse weather conditions, poor road surfaces and the actions of other road users. The company shall not be liable for any injury, disability, death, any financial loss (including consequential loss), or any additional costs incurred by you, direct or indirect, whatsoever and howsoever caused.

 

You ride at your own risk. We will not take any responsibility for decisions regarding riding conditions or injuries.

 

Nothing in these terms seeks to limit or exclude our liability if something that we do or fail to do causes death or personal injury through our negligence.

 

Except for those areas for which we do not seek to exclude liability, our total liability to you is limited to the sum that you paid us for the price of the holiday.

DISCLAIMER

All riders are required to sign our disclaimer which is reproduced on this website prior to the commencement of the tour.

 

DELAYS AND ALTERATIONS

 

The tour plan issued prior to departure is merely an expectation of the activity and progress each day. The tour leader reserves the right to make changes to the schedule during the tour as and when the need arises. It is a fundamental condition of the contract that you accept this flexibility and the delays, alterations and their subsequent results, such as inconvenience, discomfort and disappointment. The company is not liable to compensate you for any delay or alterations. We do however guarantee to get to the finish in good time to meet your flight home provided that you have pre-advised us of that flight prior to departure.

 

PAYMENT TERMS

 

A deposit of 20% is payable upon booking. The balance of 80% is payable 8 weeks prior to the departure date. The deposit is non refundable unless otherwise stated. By paying the deposit, you will be deemed to have accepted these terms and conditions and agreed to sign the disclaimer at the commencement of your tour. Where a tour is booked within 8 weeks of departure then the full payment (100%) must be made upon booking.

 

CANCELLATION

 

We reserve the right to cancel any tour for any reasons beyond our control. In such circumstances any monies paid will be refunded in full. The company will not be liable for any direct or consequential loss arising from the cancellation.

 

Tours will only operate once the minimum number of persons is reached. In these circumstances you will be entitled to move to an alternative tour free of charge or have a full refund of all monies paid.


BEHAVIOUR

 

You are expected to abide by the rules of the tour leader at all times. Antisocial or disruptive behaviour will not be tolerated and will result in a breach of contract. In such circumstances you will be required to leave the tour immediately and no refunds or compensation will be provided.

 

HOTEL BILLS

 

Any amounts owed on hotel bills other than those provided for in the joining instructions, such as laundry bills, phone calls, room service, damage to property will be paid by you directly to the hotel.

 

BAGGAGE ALLOWANCE

 

The permitted baggage allowance is one bike bag, one medium sized suitcase (or medium sized holdall) plus one small rucksack per person.

PRIVACY POLICY

The contact information that you send to us is purely for our own use. We do not share this information with third parties. We do not use Cookies or analyse any internet traffic flow at a personal level. Once we have received your details we use strict procedures and security features to try to prevent unauthorised access.

RELEVANT LAW

 

These terms and conditions are governed by the laws of England and Wales and are subject to the exclusive jurisdiction of the English Courts.
